Important Notice: Arbitration Agreement
These terms contain a mandatory arbitration agreement and class action waiver. By agreeing to these Terms, you agree to resolve disputes through binding, individual arbitration rather than in court.
1. Acceptance of Terms
By registering for, accessing, browsing, or using the AIMD platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy. If you do not agree to these Terms, do not use our platform.
2. Accounts and Age Verification
You must be at least 18 years of age, or 13 years of age with the explicit consent of a parent or legal guardian, to create an account. You are solely responsible for safeguarding your password and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process.
3. Marketplace Role
AIMD operates as a marketplace connecting independent creators ("Creators") with buyers ("Buyers").
- Not a Party: We are not a party to the contract between the Buyer and the Creator.
- No Endorsement: We do not verify, endorse, or guarantee the quality, safety, legality, or performance of any listed artifacts.
- Creator Responsibility: Creators are entirely responsible for the content they publish, including ensuring they hold all necessary intellectual property rights.
4. Payments and Refunds
All payments are processed securely via our third-party payment provider (Razorpay).
As detailed in our Refund Policy, all sales of digital goods are strictly final. We do not offer refunds once access has been granted, except in the case of a provable material defect. Unjustified chargebacks will result in immediate revocation of access and account suspension.
5. Intellectual Property and DMCA
Creators retain all ownership rights to the artifacts they publish. By publishing on AIMD, Creators grant Buyers a non-exclusive license to use the artifact subject to the specific licensing terms chosen at publish time.
If you believe your copyrighted work has been infringed upon, please refer to our DMCA Policy for instructions on filing a takedown notice.
6. Disclaimer of Warranties
The platform and all artifacts are provided "as is" and "as available" without warranties of any kind, whether express or implied.
To the fullest extent permissible by law, AIMD disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. We do not warrant that the platform will be uninterrupted or error-free, that defects will be corrected, or that the servers are free of viruses or other harmful components. We make no guarantees regarding the output or results of any AI artifacts purchased through the platform.
7. Limitation of Liability
In no event shall AIMD, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever.
This includes damages resulting from (I) errors, mistakes, or inaccuracies of content, (II) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our platform, (III) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein, (IV) any interruption or cessation of transmission to or from our platform, (V) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our platform by any third party, and/or (VI) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the platform, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.
8. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by individual binding arbitration rather than in court.
Class Action Waiver: You and AIMD agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
